A drywall company in Hermitage, Tenn., has paid back $103,300 in back wages and damages following an investigation by the Department of Labor, local television station WZTV reports. The U.S. Department of Labor's Wage and Hour Division found that Vazquez Drywall violated overtime and recordkeeping requirements.

Investigators say the company inaccurately classified employees as independent contractors, and paid them piece rates or flat salaries regardless of the number of hours they worked, causing the employees to miss out on overtime pay.

The Department of Labor also found the company failed to keep accurate payroll records. In addition to the payments in back wages, Vazquez Drywall received a $2,424 civil penalty for the damages done to employees.
